ACC Online Store Terms, Privacy, Returns and Refunds

These Terms apply to the use of the ACC Online Store and to any order placed through the ACC Online Store.

By accessing the ACC Online Store, creating an account, placing an order, or using any store service, you agree to these Terms.

1. About the ACC Online Store

The ACC Online Store is operated by or on behalf of the Australian Cadet Corps Inc. for the purpose of supplying approved uniform items, rank or award-related items, training resources, promotional items and other items connected with Australian Cadet Corps activities.

The ACC Online Store is primarily intended for use by:

  1. current Australian Cadet Corps members;
  2. parents or guardians purchasing for current youth members;
  3. authorised Australian Cadet Corps officers or representatives;
  4. Australian Cadet Corps Cadet Units; and
  5. other persons approved by the Australian Cadet Corps.

The ACC Online Store is not operated as a general public retail store. Some items may be visible to, or technically able to be ordered by, members of the public. However, the Australian Cadet Corps reserves the right to refuse, cancel, restrict or delay any order where we consider that the item is intended only for members, units, authorised personnel or persons who meet a particular rank, appointment, award or eligibility requirement.

2. Member-only and restricted items

Some products available through the ACC Online Store are restricted. Restricted items may include, but are not limited to:

  1. uniform items;
  2. rank slides, badges, insignia or appointment items;
  3. award, medal, ribbon or clasp items;
  4. items bearing Australian Cadet Corps names, logos, marks or branding;
  5. unit-specific items;
  6. items intended only for officers, cadets, particular ranks, particular appointments or award recipients; and
  7. any other item marked as restricted on the product page or determined by the Australian Cadet Corps to be restricted.

Placing an order for a restricted item does not guarantee that the item will be supplied.

Before processing, packing, dispatching or releasing an order, we may require proof of one or more of the following:

  1. current Australian Cadet Corps membership;
  2. authority to purchase on behalf of a Cadet Unit;
  3. parental or guardian authority to purchase for a youth member;
  4. rank, acting rank or appointment eligibility;
  5. award, medal, ribbon, clasp or badge eligibility;
  6. approval from a Commanding Officer, Unit Procurement Officer, Procurement Commander or other authorised Australian Cadet Corps officer; or
  7. any other information reasonably required to verify that the order is appropriate.

If satisfactory proof is not provided within the time requested, we may cancel the order and issue a refund for the cancelled item or order.

3. General public orders

The general public may be able to access the ACC Online Store or place orders through the website. This does not mean that all products are available to the general public.

Public customers may purchase only those items that the Australian Cadet Corps makes available for public sale, such as approved promotional merchandise or other unrestricted items.

We may cancel any public order, in full or in part, where the order includes restricted items or where we reasonably consider that the order may result in inappropriate possession, use or display of Australian Cadet Corps uniform, insignia, branding or related items.

4. Orders placed by Cadet Units

A person placing an order on behalf of a Cadet Unit confirms that they are authorised to do so.

If an order is placed using Cadet Unit funds or for Cadet Unit purposes, the person placing the order is responsible for ensuring that the order has been approved in accordance with Australian Cadet Corps rules, policies, financial procedures and any direction from the relevant Commanding Officer or authorised officer.

We may request written confirmation of unit authority before processing a unit order.

5. Order acceptance

When you submit an order through the ACC Online Store, you are making an offer to purchase the selected items.

An automated order confirmation, payment receipt or website confirmation means that we have received your order. It does not necessarily mean that the order has been accepted, verified or approved for fulfilment.

An order is accepted only when the Australian Cadet Corps confirms acceptance, approves the order for fulfilment, dispatches the order, releases the order for collection, or otherwise confirms that the order will be supplied.

6. Right to cancel or refuse orders

The Australian Cadet Corps reserves the right to refuse, cancel or partially cancel any order before fulfilment, including where:

  1. the order appears to be placed by or for a person who is not an Australian Cadet Corps member, authorised purchaser or eligible recipient;
  2. membership, rank, appointment, award or unit eligibility cannot be verified;
  3. the order contains restricted items that the purchaser or recipient is not entitled to receive;
  4. the order appears to be for resale, impersonation, misrepresentation or unauthorised use;
  5. the order appears fraudulent, suspicious, unauthorised or inconsistent with Australian Cadet Corps policies;
  6. payment has not been received, has failed, has been reversed, or is subject to a dispute or chargeback;
  7. a product is unavailable, discontinued, incorrectly listed or affected by a stock error;
  8. a product description, price, shipping charge or availability information was displayed incorrectly;
  9. the shipping address is incomplete, invalid, unsafe, impractical or outside our available delivery area;
  10. the order cannot be fulfilled within a reasonable time; or
  11. fulfilment would breach these Terms, Australian Cadet Corps rules or any applicable law.

If we cancel an order before fulfilment, we will refund the amount paid for the cancelled item or order, unless another remedy is required by law.

7. Prices, payment and stock availability

All prices are shown in Australian dollars.

Prices include GST where GST applies. If the Australian Cadet Corps is not required to charge GST on a particular sale, the price will be treated accordingly.

Payment must be made through the payment methods offered on the ACC Online Store at checkout.

Product availability may change without notice. We may limit quantities, place items on backorder, substitute an item with your consent, or cancel and refund an unavailable item.

Product images, colours, sizing and descriptions are provided as a guide. We will take reasonable care to describe products accurately, but minor differences may occur due to manufacturing, supplier changes, screen display settings or product updates.

8. Processing, fulfilment and delivery

The ACC Online Store is operated for the benefit of Australian Cadet Corps members and Cadet Units. It is not a commercial warehouse or fast-shipping ecommerce operation.

Unless a different timeframe is displayed on the website, orders are generally reviewed, processed, packed and fulfilled once per week.

Processing and fulfilment times may be affected by:

  1. Procurement Commander availability;
  2. volunteer or staff availability;
  3. unit activities, camps, parades or training commitments;
  4. public holidays, school holiday periods or shutdown periods;
  5. stocktake or inventory checks;
  6. supplier delays;
  7. verification of membership, rank, appointment or award eligibility;
  8. requests for additional information;
  9. payment issues;
  10. courier or postal delays; and
  11. any notice displayed on the ACC Online Store from time to time.

By placing an order, you acknowledge that dispatch or collection may not occur immediately and that your order will be shipped or made available only once processing and fulfilment can take place.

Where we become aware that an order cannot be fulfilled within the timeframe displayed on the website, or within a reasonable time, we will endeavour to contact you with an update. Depending on the circumstances, we may offer to continue processing the order, place the item on backorder, substitute an item with your agreement, or cancel and refund the affected item.

9. Shipping and collection

Available shipping, delivery or collection options will be displayed at checkout or otherwise communicated by the Australian Cadet Corps.

Orders may be:

  1. shipped to the address provided at checkout;
  2. sent to a nominated Cadet Unit;
  3. made available for collection at an approved location;
  4. delivered through an approved Australian Cadet Corps representative; or
  5. fulfilled in another way determined by the Australian Cadet Corps.

You are responsible for providing complete and accurate delivery details. If an order is delayed, returned, lost or delivered incorrectly because you provided incorrect or incomplete details, we may require you to pay any additional postage, handling or re-delivery costs, unless the issue was caused by us or the law requires otherwise.

If an order is lost or damaged in transit, please contact us as soon as possible with your order number and supporting details. We may ask for photographs, packaging, tracking information or other evidence to help assess the issue.

10. Customer cancellation requests

You may request cancellation of an order by contacting us as soon as possible after placing the order.

We may approve a cancellation request if the order has not yet been packed, specially ordered, customised, allocated, dispatched or released for collection.

We may decline a cancellation request where fulfilment has already progressed, where the item was specially ordered or customised for you, or where cancellation is not reasonably practical. This does not affect any rights you may have under Australian Consumer Law.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or protection that cannot lawfully be excluded, restricted or modified, including any rights under the Australian Consumer Law.

If a product has a major problem, you may be entitled to choose a refund or replacement.

If a product has a minor problem, we may choose to repair, replace or refund the item, as appropriate and as permitted by law.

If a product is faulty, unsafe, significantly different from its description, not fit for a disclosed purpose, or otherwise fails to meet a consumer guarantee, please contact us so we can assess the issue and provide an appropriate remedy.

12. Refund policy

Refunds may be provided where:

  1. the Australian Cadet Corps cancels an order before fulfilment;
  2. an ordered item is unavailable and no suitable alternative is agreed;
  3. the purchaser or recipient cannot be verified as eligible for a restricted item;
  4. a product fails to meet a consumer guarantee;
  5. the wrong item was supplied;
  6. the item is damaged or faulty and a refund is the appropriate remedy;
  7. we are unable to fulfil the order within a reasonable time; or
  8. the Australian Cadet Corps otherwise approves a refund.

Approved refunds will usually be processed to the original payment method. The time taken for funds to appear in your account may depend on your bank, card provider or payment processor.

Shipping costs may be refunded where required by law or where the refund relates to an error by the Australian Cadet Corps. Shipping costs are generally not refundable for approved change-of-mind returns.

13. Change-of-mind returns and exchanges

We are not required to provide a refund or exchange if you simply change your mind, choose the wrong size, order the wrong item, no longer need the item, or find the item cheaper elsewhere.

However, we may, at our discretion, approve a change-of-mind exchange or store credit if:

  1. you contact us within [14] days of receiving the item;
  2. the item is unused, unworn, unwashed and in original saleable condition;
  3. the item is returned with tags, packaging and proof of purchase where applicable;
  4. the item is not a restricted rank, award, personalised, custom, clearance, hygiene-sensitive or special-order item;
  5. the requested replacement item is available;
  6. the purchaser or recipient is eligible to receive the replacement item; and
  7. you pay any applicable return postage, re-delivery cost or price difference.

Change-of-mind returns must be approved before the item is returned. Items sent back without prior approval may not be accepted.

14. Returns and exchanges for uniform items

Uniform items must be returned in clean, unused, unworn and saleable condition unless the return is due to a fault, incorrect supply or another issue covered by Australian Consumer Law.

Uniform items that have been worn on parade, worn at training, altered, named, labelled, washed, damaged, marked or otherwise used may not be accepted for change-of-mind return or exchange.

Where a uniform item is supplied in the wrong size due to an error by us, we will work with you to provide an appropriate remedy.

Where the wrong size was ordered by the purchaser, we may offer an exchange at our discretion if the item is still in saleable condition and replacement stock is available.

15. Restricted rank, award and insignia items

Rank, appointment, award, medal, ribbon, clasp, badge and insignia items may be subject to additional eligibility checks.

We may refuse to supply, exchange or replace restricted items unless we are satisfied that the recipient is eligible to possess or wear the item.

If you accidentally order an item for which the recipient is not eligible, contact us promptly. We may cancel the item before fulfilment and issue a refund.

If an ineligible purchase is identified after fulfilment, the Australian Cadet Corps may request return of the restricted item and may take any action available under Australian Cadet Corps rules, policies or applicable law.

16. Faulty, damaged or incorrect items

If you receive a faulty, damaged or incorrect item, contact us as soon as possible at [insert email] and include:

  1. your order number;
  2. your name and contact details;
  3. a description of the issue;
  4. photographs of the item, packaging and any damage, if relevant;
  5. whether you are seeking a repair, replacement, exchange or refund; and
  6. any other information reasonably needed to assess the issue.

Please do not dispose of the item or packaging until we have had a reasonable opportunity to assess the issue.

Where the product is confirmed to have a fault, damage or supply error for which we are responsible, we will provide a remedy required by law and may reimburse reasonable return postage where required.

17. Second-hand or used items

Some items may be sold as second-hand, used, surplus, clearance or “as is”.

Where an item is sold as second-hand or used, the product page should describe the condition of the item as accurately as reasonably possible.

You are not entitled to a remedy for a defect or condition that was clearly disclosed before purchase, unless required by law. You may still be entitled to a remedy for an undisclosed fault or where the item otherwise fails to meet a consumer guarantee.

18. Product use and ACC standards

Uniform items, insignia, awards and branded items must be used, worn and displayed only in accordance with Australian Cadet Corps rules, policies, handbooks and lawful directions.

Purchasing an item through the ACC Online Store does not grant permission to wear a uniform, display a rank, claim an appointment, claim an award, represent the Australian Cadet Corps, or use Australian Cadet Corps branding except as authorised.

Promotional items are not uniform items unless clearly stated.

19. No unauthorised resale

Items purchased through the ACC Online Store must not be resold, commercially exploited, copied, modified, misrepresented or used in a way that may bring the Australian Cadet Corps into disrepute.

We may refuse future orders from any person we reasonably believe has purchased items for unauthorised resale or misuse.

20. Website accounts and accurate information

You must provide accurate, complete and current information when using the ACC Online Store.

You must not use another person’s details without permission.

If account functionality is provided, you are responsible for maintaining the confidentiality of your login details and for activity that occurs under your account.

We may suspend or cancel access to the ACC Online Store if we reasonably believe an account has been misused or used in breach of these Terms.

21. Orders involving youth members

Where an order is placed for or by a person under 18 years of age, the Australian Cadet Corps may require involvement, consent or confirmation from a parent, guardian, Commanding Officer or authorised adult member.

A parent or guardian who places an order for a youth member is responsible for ensuring that the order is appropriate and that any restricted item is ordered only for an eligible recipient.

22. Privacy policy

This section explains how the Australian Cadet Corps collects, uses, stores and discloses personal information in connection with the ACC Online Store.

22.1 Information we collect

We may collect personal information including:

  1. name;
  2. email address;
  3. phone number;
  4. billing address;
  5. delivery address;
  6. Australian Cadet Corps membership status or membership number;
  7. Cadet Unit;
  8. rank, appointment or role;
  9. award, medal, badge or eligibility information;
  10. parent or guardian details where relevant;
  11. order details and purchase history;
  12. payment confirmation, transaction references and refund records;
  13. communications with us;
  14. delivery and tracking information;
  15. website account details;
  16. IP address, device, browser and website usage information; and
  17. any other information you provide to us or that we reasonably need to process, verify or fulfil an order.

We do not intentionally collect payment card numbers unless expressly stated. Payment card details are usually processed by third-party payment providers. We may receive transaction confirmations, payment status information and limited payment details, such as the last four digits of a card or payment reference.

22.2 How we collect information

We may collect personal information when you:

  1. visit the ACC Online Store;
  2. create an account;
  3. place an order;
  4. complete checkout;
  5. contact us;
  6. request a return, exchange or refund;
  7. provide proof of membership, rank, appointment or award eligibility;
  8. subscribe to store updates or marketing;
  9. respond to a verification request; or
  10. otherwise interact with the ACC Online Store.

We may also collect information from Australian Cadet Corps officers or records where reasonably required to verify membership, unit authority, rank, appointment, award eligibility or order legitimacy.

22.3 Why we collect and use personal information

We may collect, hold, use and disclose personal information to:

  1. operate the ACC Online Store;
  2. process, verify, fulfil and deliver orders;
  3. confirm membership or unit authority;
  4. verify rank, appointment, award or item eligibility;
  5. communicate about orders, returns, exchanges and refunds;
  6. manage stock, inventory and procurement;
  7. issue receipts and maintain financial records;
  8. prevent fraud, misuse or unauthorised access to restricted items;
  9. comply with Australian Cadet Corps rules, policies and procedures;
  10. comply with legal, accounting, audit and record-keeping obligations;
  11. improve the ACC Online Store and customer experience;
  12. respond to complaints, disputes or enquiries; and
  13. send store updates or marketing communications where permitted.

22.4 Who we may disclose information to

We may disclose personal information to:

  1. Australian Cadet Corps officers, officials, committee members or authorised personnel involved in procurement, finance, administration, command, compliance or verification;
  2. the relevant Cadet Unit, Commanding Officer or authorised unit representative;
  3. payment processors;
  4. ecommerce platform providers;
  5. website hosting and IT service providers;
  6. couriers, postal providers and delivery partners;
  7. accounting, audit, insurance or professional advisers;
  8. government, regulatory or law enforcement bodies where required or permitted by law; and
  9. any other person or organisation where you have consented or where disclosure is reasonably necessary for store operations.

We do not sell personal information.

22.5 Overseas service providers

Some service providers used to operate the ACC Online Store, process payments, host data, provide email services or manage delivery may store or process information outside Australia.

Where we use overseas service providers, we will take reasonable steps to select reputable providers and handle personal information appropriately.

22.6 Security

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

Security measures may include access controls, password protection, payment provider security, limited staff access, secure systems and record-keeping procedures.

No online store, payment system or email system can be guaranteed to be completely secure. You should contact us promptly if you believe your information or account has been misused.

22.7 Access and correction

You may request access to personal information we hold about you.

You may also ask us to correct personal information that is inaccurate, out of date, incomplete, irrelevant or misleading.

We may need to verify your identity before responding to an access or correction request.

22.8 Privacy complaints

Please include enough information for us to understand and respond to the issue.

We will aim to respond within a reasonable time.

23. Marketing communications

We may send store updates, restock notices, product announcements or promotional communications where you have consented or where we are otherwise permitted to do so.

You may unsubscribe from marketing communications using the unsubscribe link or instructions provided in the message, or by contacting us via https://cadets.org.au/contact/.

Transactional messages, such as order confirmations, payment receipts, eligibility checks, dispatch notices, collection instructions and refund updates, are not marketing messages and may still be sent where necessary to manage your order.

24. Cookies and website analytics

The ACC Online Store may use cookies, analytics tools or similar technologies to operate the website, remember preferences, manage carts, improve performance, prevent fraud and understand website usage.

You can control cookies through your browser settings, but disabling cookies may affect website functionality.

25. Intellectual property

The Australian Cadet Corps name, logos, badges, designs, materials, images, documents, product designs, website content and related intellectual property remain the property of the Australian Cadet Corps or its licensors.

You must not copy, reproduce, modify, distribute, sell, display or use Australian Cadet Corps intellectual property without written permission, except as expressly permitted by the Australian Cadet Corps.

Purchasing an item from the ACC Online Store does not grant any intellectual property licence or permission to use Australian Cadet Corps branding outside authorised purposes.

26. Limitation of liability

To the maximum extent permitted by law, the Australian Cadet Corps is not liable for indirect, incidental, special or consequential loss arising from use of the ACC Online Store or delay in order processing, fulfilment or delivery.

Nothing in this clause limits any liability that cannot lawfully be limited, including liability under Australian Consumer Law.

27. Changes to these Terms

We may update these Terms from time to time.

The version published on the ACC Online Store at the time you place an order will generally apply to that order, unless a change is required by law or is otherwise stated.

The current version of these Terms will be available on the ACC Online Store.

28. Governing law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia.
